1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your use of the website somawa.com ("Website") and the purchase of products and services offered by Icpure India Pvt. Ltd., a company incorporated under the laws of India, trading as "SOMAWA" ("Company", "we", "our", "us").

By accessing the Website, placing an order, or using any of our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Website or purchase our products.

2. Products & Services

SOMAWA designs and manufactures alkaline water ionizers for residential use. Our product range includes the Modish, Amara, Amara NXT, Udaka, and Toya models.

All SOMAWA products are wellness devices engineered to restructure water by adjusting pH levels and infusing molecular hydrogen. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Product descriptions, specifications, and images on the Website are provided for informational purposes and are as accurate as reasonably possible. We reserve the right to update product specifications, pricing, and availability without prior notice.

Individual experiences with our products may vary based on personal circumstances, water quality, usage patterns, and other factors. Any wellness-related statements on the Website reflect the experiences reported by individual customers and should not be construed as guaranteed outcomes.

3. Ordering & Payment

Orders may be placed through the Website, over the phone, or through an authorised SOMAWA representative. All orders are subject to acceptance and product availability.

By placing an order, you confirm that:

• You are at least 18 years of age.
• The information provided is accurate and complete.
• You are authorised to use the payment method selected.

We accept payments via major credit cards, debit cards, net banking, UPI, and select EMI options through our secure payment gateway partners. All payment information is processed securely and is not stored on our servers.

Booking amounts are non-refundable. A booking confirms your intent to purchase and reserves your place in our consultation and installation schedule. The booking amount will be adjusted against the total product price.

Prices displayed on the Website are in Indian Rupees and are inclusive of applicable GST unless stated otherwise. We reserve the right to modify pricing at any time. Price changes will not affect orders already confirmed.

4. Shipping & Delivery

SOMAWA ships across India. Standard delivery timelines are 3 to 5 business days from order confirmation, though actual delivery times may vary depending on your location and logistical conditions.

Shipping costs vary by location and will be communicated at the time of order. Delivery to remote or difficult-to-access areas may involve additional charges or extended timelines.

Risk of loss and title for products pass to you upon delivery to the shipping carrier. While we take every care in packaging, please inspect the product upon delivery and report any shipping damage to us within 48 hours at [email protected].

5. Installation

Professional installation by a trained SOMAWA technician is required for all products. Installation is charged separately from the product price and is not included in the listed product investment.

Installation charges vary by location and will be communicated to you prior to scheduling. Our technician will:

• Install the machine and connect it to your existing water line.
• Conduct a demonstration and walk your household through the product's features.
• Complete the handover and ensure you are familiar with all features and settings.

For any post-installation service requests, complaints, or support needs, customers must contact SOMAWA exclusively through the official support number +91-98999-39966 or [email protected]. Direct contact with technicians is not permitted for service requests.

You are responsible for ensuring adequate space, a functional water line, and electrical access at the installation site. Any plumbing or electrical modifications required prior to installation are your responsibility.

6. Warranty

All SOMAWA products carry a standard 1-year manufacturer warranty from the date of installation. The warranty covers defects in materials and workmanship under normal residential use.

The warranty covers:

• Manufacturing defects in the ionisation chamber and internal components.
• Electrical component failure under normal operating conditions.
• Repair or replacement of defective parts, at our sole discretion.

The warranty does not cover:

• Damage resulting from misuse, negligence, or unauthorised modification.
• Damage caused by improper installation (not performed by a SOMAWA technician).
• Normal wear and tear. Note: the first-year filter set required for replacement is provided with the machine at no additional cost. Subsequent filter replacements are the customer's responsibility.
• Damage caused by power surges, flooding, or other external factors.
• Products used for commercial or industrial purposes unless specifically agreed in writing.
• Cosmetic damage that does not affect functionality.

7. Limitation of Liability

SOMAWA products are wellness devices designed to restructure drinking water. They are not medical devices and make no medical claims. Nothing on the Website or in our marketing materials should be interpreted as medical advice.

To the maximum extent permitted by applicable law:

• The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use our products or services.
• The Company's total liability for any claim shall not exceed the amount paid by you for the specific product giving rise to the claim.
• The Company does not guarantee specific wellness outcomes. Individual experiences vary based on personal health, water source quality, usage patterns, and lifestyle factors.

This limitation of liability applies regardless of the legal theory under which liability is asserted, including contract, tort, negligence, strict liability, or any other basis.

8. Cancellation & Refund

Booking amounts are non-refundable once payment is confirmed. No refunds will be issued after product installation has been completed.

9. Intellectual Property

All content on the Website, including but not limited to text, graphics, logos, images, product designs, trademarks, trade names, and software, is the property of Icpure India Pvt. Ltd. or its licensors and is protected under applicable intellectual property laws of India and international treaties.

"SOMAWA", the SOMAWA logo, and all product names (Modish, Amara, Amara NXT, Udaka, Toya) are trademarks of the Company. You may not use, reproduce, modify, or distribute any of our intellectual property without prior written consent.

10. User Conduct

By using the Website, you agree not to:
